SC Rejects Appeal Challenging Acquittal Of Peepli Live Co Director Mahmood Farooqui In Rape Case

The Supreme Court on Friday will hear a plea by an American woman challenging Delhi High Court's order acquitting Peepli Live co-director Mahmood Farooqui in a rape case, said a media report.

The Delhi High Court in September previous year, had acquitted the Peepli Live co-director in the high profile "rape case" involving a USA ressearcher raising doubt over "varacity of incident" and complaint.

In a controversial verdict, the Delhi high court had said when someone says "no", it might not always mean "no".

"In cases where the parties are known to each other, it could be really hard to decipher whether a feeble "no" - little or no resistance - actually amounts to denial of consent", said Justice Ashutosh Kumar.

The bench was not satisfied with the answers given by the counsel and dismissed the plea, saying no question of law was involved in the matter.

A trial court had on August 4,2016 sent Farooqui to jail for seven years, observing that he had taken advantage of the situation when the victim was alone in his house.

The Delhi HC had in 2017 acquitted Farooqui of rape charges. The HC quashed the trial court's "guilty" verdict saying it found the claim of rape unreliable, noting the woman had faked an orgasm during the alleged crime. The 35-year-old complainant had alleged that Farooqui, a writer and director, had raped her at his Delhi home on March 28, 2015.
