Alberta declares 'definitive victory' on Trans Mountain appeal in federal court

The Federal Court of Appeal dismissed the BC government's bid to challenge a National Energy Board ruling that allows Kinder Morgan to bypass local bylaws during construction.

Horgan said the federal government refused his request to join with B.C.to clarify in court his intent to consult on new regulations regarding the Trans Mountain pipeline expansion project.

Notley calls it a victory for the pipeline, the economy, Alberta's climate plan and for all Canadians.

On Friday, the Federal Court of Appeal announced that it wouldn't hear the appeal from the City of Burnaby and the provincial government.

Notley has aggressively pushed for the pipeline, which would allow oil companies in her province to diversify away from their main market in the United States - the biggest customer of Canadian crude.

"The court system should be the body that decides whether or not this is fair and just, but they dismissed our application without reasons", said Corrigan.

Opposition to the project has spilled out onto the streets in recent weeks, with dozens of arrests at anti-pipeline rallies near Kinder Morgan sites and protests across Burnaby and even south of the border.

The NEB ruling exempts Trans Mountain from following Burnaby's permitting and tree bylaws, arguing that the bylaws were unconstitutional because they conflicted with the federal government's approval of the project.

"Our government will continue to explore other legal ways to defend the interests of British Columbians against this unnecessary project".

Notley kept open the possibility that the wine ban could return if B.C. continues with what she says is an illegal effort to dictate what can flow through an inter-provincial pipeline.

Alberta Premier Rachel Notley commented on the decision on social media on Saturday, saving it was another win for the interests of Canada. "Your Alberta government will not back down until this pipeline is built and the national interest is secured".
