Latest india news Supreme Court asks trial court not to proceed with Jay Shah’s defamation case against The Wire

The bench also observed that the media should be more responsible and said it can not write whatever it feels about anyone.

"The question of gagging the media does not come at all".

A Supreme Court bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud asked Jay Shah and others, who have filed the complaint against The Wire, to respond within two weeks to the plea filed by the journalists against the Gujarat High Court's order, refusing to quash summons issued against them by the trial court.

Commenting on the role of the media, Chief Justice Dipak Mishra said "we expect the media should be responsible, electronic media should be more responsible".

"Electronic media can't think they become Popes overnight", Misra said while hearing a defamation case against news portal The Wire filed by Bharatiya Janata Party president Amit Shah's son, Jay Shah. "They can not feel they are above everything", he added. "Sometimes whatever they write amounts to sheer contempt of court".

Jay Shah had filed a criminal defamation case in a metropolitan court in Gujarat in November previous year against news portal The Wire over a report claiming his firm's turnover grew exponentially after the party came to power in 2014. The website is facing a Rs 100 crore damage suit, filed by Jay Shah, in October 2017.

Additional Chief Metropolitan Magistrate S K Gadhvi had ordered a court inquiry into the matter under CrPC section 302.

Shah had filed a defamation case against the Wire in response to the news story published on the portal under the heading "The Golden Touch of Jay Amit Shah".

Jay Shah maintained that the story is "false, derogatory and defamatory", while The Wire argued that its story was a "straight forward narration" of the "facts available in the public domain" and that it neither "asserted honesty nor dishonesty but held the sequence of events out for public scrutiny", Live Law reported.

"Journalistic freedom can not be throttled". "If journalism is going to be throttled like this, no journalist can ask questions", he said. Mr. Sibal referred to how certain insinuations were made against a sitting HC judge that he was senior advocate P. Chidambaram's junior.

Sibal did not name anyone.

The bench, however, was critical of the way news websites are writing reports and asked the media to be more responsible. "That's not culture of journalism".

"I have told many times about Freedom of Speech and Expression. But you can not write anything or whatever strikes your imagination".
