
This is the final tally of votes in the senate
Saddled with one of the worst-funded public retirement systems in the country and defying a powerful teachers union that vowed political retribution, Republican lawmakers in Kentucky passed a pension overhaul Thursday that preserves benefits for most workers and does little to address the state's massive debt.
Legislative pensions will also be transitioned to the same cash-balance system provided to future employees in this version of the bill.
The legislation is House Bill 185.
The House vote came after a lengthy debate in which Democrats questioned the legality of passing a pension bill so quickly without an analysis of how it would affect the system.
The bill would freeze the number of sick days teachers can use toward retirement eligibility to those accumulated by July 1 of this year.
The bill would also cap the amount of sick leave that teachers can accrue for retirement purposes as of December 31, 2018. And current workers would not have to work longer to qualify for full benefits. The bill would change that, letting spouses receive 75 percent of their loved one's salary.
The Kentucky Education Association, which represents teachers and other education professionals, slammed the maneuver as a "classic legislative bait and switch".
That law reads, in part: "A bill which would increase or decrease the benefits or increase or decrease participation in the benefits or change the actuarial accrued liability of any state-administered retirement system shall not be reported from a legislative committee of either house of the General Assembly for consideration by the full membership of that house unless the bill is accompanied by an actuarial analysis". But Kentucky is at least $41 billion short of the money it needs to pay retirement benefits over that same time. Republican Rep. John "Bam" Carney said lawmakers expect it to save $300 million over the next 30 years. Most of the changes would impact new hires.

The new pension bill does not include a controversial provision that would reduce cost of living adjustments for retired teachers, which was included in previous proposals. It preserves most benefits for public employees.
"We're not passing this bill as a solution. And that's why I have chosen to take this stance today to try to help calm our educators and others to say this is necessary to solidify your future pension", Rep. John "Bam" Carney said. And the new, almost 300-page Senate Bill 151 passed both the state House and Senate Thursday to the chagrin of teachers and retirees who crammed into the Capitol. But the bill still drew the ire of hundreds of teachers protesting in the Capitol, with many chanting they would vote lawmakers out of office in November.
Rep. Carney, a teacher from Campbellsville and sponsor of the amendment, criticized protestors during a speech on the House floor. That may not be a significant amount at first - but over time as older teachers retire, the hybrid cash plan will cover an ever larger portion of a district's employees.
"I say do your job, don't talk about politics and teach the kids".
During committee discussion Thursday, Rep. Jim Wayne (D-District 35) claimed the bill was illegal during the meeting.

The GOP-controlled House of Representatives approved the bill Thursday night by a 49-46 vote. "Anyone who will receive a retirement check in the years ahead owes a deep debt of gratitude to these 71 men and women who did the right thing".
