Mother charged with negligent homicide in baby's death after off-duty cop slammed into their car at 94 mph

Brittany Stephens, mom to a one-year-old baby who died in a crash involving an off-duty officer in Baton Rouge in October, was arrested Tuesday for failing to properly secure the auto seat, The Advocate reports.
Though Stephens told officials that she had buckled her daughter into the vehicle seat, investigators concluded that the auto seat was not, in fact, secured and that the placement of the straps did not correlate with her daughter's height.
On Tuesday, Stephens, still grieving the loss of child, was arrested by Baton Rouge police and charged with one count each of negligent homicide and a seatbelt violation. Baton Rouge Police spokesperson Sgt. L'Jean McKneely said Stephens, as the mother of the infant, was "the person responsible for the buckling of the auto seat". Breea Gross, 18, who was driving at the time, was cited for driving without a license, as well as three counts of child safety restraint violation and a seat belt violation. Janice Gross, 40, was cited for allowing an unlicensed driver to drive her vehicle and seat belt violation.

Manuel is a 27-year-old officer with the Baton Rouge Police Department in Louisiana who was off duty at the time, according to WAFB.
Officer Manuel, 28, was arrested on February 16 and charged with negligent homicide and speeding.
The collision caused the Nissan to flip over, according to WAFB, and the baby died about two weeks later in a hospital.
Stephens posted $3,600 bond and had been released from jail by Wednesday morning, according to online prison records.
Manuel, already released on a $15,000 bond, is on paid administrative leave, according to WBRZ. "East Baton Rouge District Attorney Hillar Moore III said Tuesday his office has not yet determined whether Stephens or Manuel will face charges, but prosecutors 'will review all reports, charges and arrests and make the appropriate decisions based upon facts and law'".
