SC ST Atrocities Act Government to file review petition before Supreme Court on Monday
One person was killed in Muzaffarnagar and over 100 were injured on Monday as violence singed many parts of the state during the "Bharat Bandh" enforced by Dalit groups in protest against a ruling of the Supreme Court with regard to the SC/ST Prevention of Atrocities Act, police said.
The Centre has stated in its petition that the changes proposed by the Supreme Court may not only dilute the protection offered to SC/ST communities but would also question the very objective of promulgating the Act. This bench, of Justice AK Goel and UU Lalit, is the same one that made the ruling on the SC/ST Act last month, reported TOI.
The Top Court had appointed Amarendra Saran, senior Supreme Court lawyer as the Amicus Curiae (Friend of the court) to assist in the matter. Reports of violence and police action to control crowds came from Punjab, Bihar, Chhattisgarh, Odisha, Jharkhand, Madhya Pradesh and other parts of the country as well.
Babu Ram Pal, while addressing the workers at Sher-e-Kashmir Bhavan, expressed solidarity with the organisations fighting for just cause of the weaker sections of the society, especially Scheduled Castes and said every possible legal course should be adopted to defend the Act during the review petition.

"It (the verdict) adversely affects a substantial portion of the population of India being the members of SC/ST".
On March 20, the apex court had introduced the provision of anticipatory bail in the Act while directing that there would be no automatic arrest on any complaint filed under the law. "They have, in several brutal incidents, been deprived of their life and properties, serious crimes are committed against them for various historical, social and economic reasons", it said. We have not diluted a single provision of the Act. "The enormous pain and injury caused on the commission of offence against SC/ST is the worst form of violation of Article 21 requiring complete and strict implementation of the provisions of the Act".
After hearing the parties, the Bench agreed to hear the review petition in open court, provided CJI Misra constitutes the bench. "It is harmful for tribal people like us, and they will deprive Adivasi people of their rights", Mr Toppo said, adding, "Without the Centre's green signal, judges can not issue anti-people judgments". He added that the government is responsible for maintaining law and order.
The court gave the reason that over certain occasions, the law was subject to misuse many times with the aim of preventing public servants from doing their duty.
