Juror's 'Guilty' Comment Prompt Cosby's Lawyers To Ask For Removal

Bill Cosby's lawyers scored a pair of rulings crucial to their strategy of painting his accuser as a money-grubbing liar, but they could not get the one prospective juror who seemed most willing to consider that idea.

Cosby's second trial will also play out against the backdrop of the #MeToo movement, which last autumn prompted a wave of sexual assault and misconduct accusations against dozens of powerful men in Hollywood, business and politics. They also want the other jurors questioned to see if they were influenced by the man's alleged comment.

The battle over the Black juror's removal Wednesday highlighted a vast racial disparity that limited the number of Black people available for consideration in the suburban Philadelphia jury pool.

The county says the names of people called for jury duty are selected randomly from a master list that combines voter registration records and driver's license records. The woman rejected on Wednesday was the only Black person to reach that stage.

Castor was district attorney in 2005 when Constand first told police Cosby had drugged and molested her. Castor ended his investigation into Cosby after four weeks, announcing the comedian wouldn't be charged because the evidence showed both parties "could be held in less than a flattering light".

Cosby faces three felonies stemming from allegations by a former Temple University women's basketball administrator who says Cosby, a Temple alum and longtime trustee, gave her pills that made her woozy, then assaulted her at his home in the Philadelphia suburbs in 2004. She said in her affidavit that some people being considered for the jury were sitting close enough to overhear the conversation and they may have heard the comments about Cosby. Cosby returned to court last month just a few days after the death of his 44-year-old daughter Ensa.

The defense wanted a man who said he thought numerous women coming forward in the #MeToo movement were "jumping on the bandwagon", but prosecutors used a challenge to send him home. The rest are millennials or on the cusp of middle-age.

"It's not a good day for the defence whenever a judge allows these types of witnesses to be called", said Douglas Sughrue, a Pittsburgh-based defence lawyer.

The man, who spoke to The Associated Press on condition of anonymity because of the sensitivity of the deliberations, had insight into what jurors could be in for when they deliberate the charges. "And the tears came towards the end, it was so tense". Cosby claims that the experience was consensual.

The AP does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.
