Steve Tew, the chief executive of New Zealand Rugby (NZR), believed that they have legal authority to block Shields from playing for England in June.

"It is a work in progress".

"We are obligated to release players who have signed to play for other countries so they have made themselves unavailable for New Zealand", Tew added.

Shields was born in New Zealand and has played all of his rugby there but he is eligible for Eddie Jones' side due to his parents being English. "We have only just, I think this morning, got a formal request to consider releasing Brad", confirmed Tew, as per Stuff. "And so World Rugby regulations don't apply per se", he added, referring to the fact that World Rugby would typically rule in favour of a player being allowed to prioritise global commitments over those to a club side.

Shields is a flanker for the Hurricanes and he has had an excellent season so far helping his side to the top of the Super Rugby rankings.

The Telegraph has reported that the RFU have cleared the way for Jones to pick Shields this June, despite still being based in New Zealand. If he had been picked for the All Blacks we wouldn't be having this conversation but he hasn't made that cut and is now taking a different direction.

Asked about Shields' long service with Wellington and the Hurricanes and whether that will play a part in the decision, Tew said: "We'd treat any request from our employees on its merits and take into account all sorts of factors".

England are set to win the tug of war with New Zealand for Wasps-bound forward Brad Shields.

But it is understood that argument will fall on deaf ears if the case makes its way to World Rugby - the sport's governing body - and Shields will be allowed to win England caps.
