German prosecutors announced on Tuesday that they are seeking to extradite the former leader of Spain's Catalonia Carles Puigdemont, who was recently arrested in Germany. If the court agrees to the request, prosecutors would still need to issue an order signing off on Puigdemont's extradition.

"Today, the attorney general of Schleswig-Holstein has petitioned the regional court to issue an extradition order against the former regional president of Catalonia, Carles Puigdemont, in accordance with article 15 of German law relating to global cooperation in criminal matters", the statement said.

The prosecutors asked the Higher Regional Court in Schleswig to rule for Puigdemont's continued detention to prevent the risk of absconding.

In a first step, the court will assess whether to accept the formal application by the state chief public prosecution office to place the suspect in extradition custody on the basis of evidence provided by Madrid.

He and 12 other separatist leaders were officially charged with rebellion.

It remains unclear at this point, whether German judicial authorities will pursue this line of legal reasoning further or focus on the charge of "rebellion".

The former Catalan leader was arrested late last month, while driving into Germany from Denmark.

Mr Puigdemont was detained in Germany on March 25 as he attempted to drive from Finland to Belgium, where he now resides. The ex-premier was living in a self imposed exile in Belgium and was in Finland on March 24, when Spain reactivated the European arrest warrant against him.

Prosecutors also argued that it was reasonable for Puigdemont to be brought up on charges of misuse of public funds since the Catalonia independence referendum cost more than a million and a half euros.
