High Court in Gujarat on Friday overturned the decision of a former state minister who was sentenced 28 years in jail for her part in the murder of 97 people in the 2002 Gujarat riots. The court upheld the conviction of former Bajrang Dal Babu Bajrangi.

The two-judge bench of justice Harsha Devani and justice AS Supehiya had concluded the hearing in August 2017 and reserved the order.

In 2012, special judge Jyotsna Yagnik sentenced 32 persons including former minister Maya Kodnani and Bajrangi and acquitted 29 others.

The High Court today upheld the conviction of Bajrang Dal lead Babu Bajrangi, who was earlier sentenced to life imprisonment by the trial court.

Seven accused were given enhanced life imprisonment of 21 years, which they will serve after undergoing 10 years imprisonment under IPC section 326 (causing grievous hurt).

The rioting took place on February 28, 2002, in the Naroda Patiaya area of Ahmedabad where a mob killed 97 people, majority from a minority community.

Up to 2,500 people, a lot of them Muslims, were hunted down and hacked, beaten or burnt to death during the riots in 2002, activists say, in retaliation for the burning of a train carrying Hindu pilgrims in which 59 people were killed.

The Gujarat High Court's verdict came a day after Supreme Court of India dismissed a number of petitions seeking probe into the death of Justice Loya.

The Bharatiya Janata Party Minister was one of the key accused in the riot case and was convicted by a special SIT court in August 2012.

The special court had sentenced 32 people, including Kodnani and Bajrangi.

Deputy Chief Minister Nitin Patel also welcomed the verdict and said if Kodnani wanted, she could be active in politics again. According to the trial court that held Kodnani, said she was the mastermind of the violence in Naroda-Patiya area. In all, the high court will decide on 31 appeals as one convict had died while the appeal was pending in the HC.

Along with Kodnani, Ganpat Chhanaji, Vikram Rathod, Manubhai Maruda, Shashikant Patil, Babubhai Marvadi, Ashok Sindhi, Mukesh Rathod and Hiro Marvadi were also acquitted.

Maya Kodnani was granted bail in 2014 after she said she was very unwell; she was reportedly given shock therapy for depression.
