US Sues California Over Law Interfering With Federal Land Sale

The U.S. Department of Justice is suing California over a law that aims to give the state power to override the sale of federal lands, the latest battle between President Donald Trump and the nation's most populous state.

The law, known as SB 50, purports to prevent county and state employees from recording the transfers of deed of federal public land unless a California commission is given a "right of first refusal" to arrange the transfer to its own chosen entity, presumably the state itself.

California Attorney General Xavier Becerra defended the state's restrictions on federal land sales.

The U.S. Justice Department is challenging the constitutionality of another California law just weeks after suing the state over its so-called sanctuary laws. Politico, the Washington Post and the Associated Press have coverage of the suit, filed in federal court in Sacramento. They cited concerns that the Trump administration would allow more logging, oil drilling or development on some of the 46 million acres owned by the federal government in California.

The suit also says California was admitted to the union in 1850 based on the express condition that it "shall pass no law and do no act whereby the title of the United States to, and right to dispose of, [its lands] shall be impaired or questioned".

California and the Trump administration have been engaged in a series of legal fights over federal policies, and last month Sessions came to Sacramento to announce the filing of a suit seeking to kill three state laws created to protect undocumented immigrants from federal authorities.

This legal position now poses a huge problem for land seizure advocates in states like Utah, which has been threatening a lawsuit to force the federal government to dispose of national public lands.
