Justice Subrata Talukdar had issued the ruling on a public interest litigation filed by opposition BJPchallenging the SEC's withdrawal of the extended deadline and alleging widespread violence allegedly aimed at detering the opposition candidates from filing nominations for the civic polls.
Kolkata: The Calcutta High Court on Thursday asked the West Bengal State Election Commission to submit affidavits detailing the steps it had taken following the Supreme Court's direction to allay apprehensions about the Panchayat elections, and extended its stay on the polling process till Friday afternoon.
Following the order, SEC will have to announce new dates for rural polls, which was earlier scheduled in the first week of May. All the parties sought orders from the court so that their prospective candidates could file nominations and contest.
Reacting to the court's order, the BJP said the ruling Trinamool Congress has been exposed.
"Even if any aggrieved party does not move the higher court to challenge Friday's verdict, it is impossible for the commission to stick to the earlier schedule as too much time has been lost", said the lawyer.

On the night of April 9, the state election commission issued a notification extending the filing of nomination by a day (till 3 pm on April 10).
Justice Talukdar asked the state government as to what authority it has to advise the SEC that it can not extend the date for nomination.Panchayat department secretary Sourav Das told the court that the state appoints the dates for elections considering a lot of factors including the weather. He cited two letters - one by the state government and the other by Trinamool Congress vice-president Kalyan Banerjee - that pointed out legal infirmities in the previous notification.
"What we now need to see is whether the court cancels the entire election process and orders the commission to declare polls afresh", he said. At the high court, Justice Subrata Talukdar suspended all processes of the Bengal rural polls till April 16.
However, the top court transferred the case to the Calcutta High Court.
