Bombay High Court grants bail to former Maharashtra Dy CM Chhagan Bhujbal in PMLA case

Bhujbal was arrested on March 14, 2016 by the Enforcement Directorate.

After more than two years of his incarceration in a money laundering case, former Deputy Chief Minister and senior NCP leader Chhagan Bhujbal was on Friday finally granted bail by the Bombay High Court on various grounds, including his frail health and advanced age.

The probe agency had claimed that the Bhujbal family, along with several others, had conspired to "launder" kickbacks received by Chhagan Bhujbal, at a time when he was holding the portfolio of Public Works Department minister in the Maharashtra cabinet. Bhujbal had moved another plea last month.

The court granted a bail on a personal bond of Rs 5 lakh.

However, former AAP leader and anti-graft activist Anjali Damania pointed out that the court has only granted him bail, "he has not been exonerated or acquitted in the corruption cases and he will again go to jail". Bhujbal in his application said that he should be sympathetically reviewed and released on bail.

Bhujbal's son and NCP legislator Pankaj and his nephew Sameer are also accused in the case.While Pankaj was granted interim bail, Sameer was arrested in the case and is in jail.

He had contended that he had recently undergone angioplasty, and was suffering from various ailments which needed medical attention.

Former Deputy CM's lawyer Vikram Chaudhary appealed to the court that Bhujbal's health is at stake.

Additional Solicitor General Anil Singh, who appeared for the ED, opposed the bail plea, arguing that though section 45 of the PMLA has been struck down, Chhagan Bhujbal could still be presumed prima facie guilty for the offence of money laundering under section 24 of the Act.

He was lodged in the high-security Arthur Road Jail in Mumbai after his conviction in the alleged money laundering case.
