So moving forward, survivors will be free to choose to resolve their individual claims in the venue they prefer: in a mediation where they can choose confidentiality; in arbitration, where they can choose to maintain their privacy while pursuing their case; or in open court.

Tony West, Uber's chief legal officer and former associate attorney general during the Obama administration, said the decision for survivors to tell their stories, if they choose, "ought to reside with the survivor".

Uber has agreed to change their terms of service which previously required Uber passengers that were sexually assaulted by Uber drivers to enter arbitration, CNN reports. That would include rides and deliveries, as well such incidents that happen before pick up or after drop off. Uber said it hoped to have the system, which it is working on with 80 women's groups, in place by the end of the year.

Starting immediately, customers with assault claims against Uber drivers will no longer be forced to pursue their cases through arbitration.

Uber did not provide details on the number of sexual harassment cases that are pending or have been settled, but when contacted by Reuters it said it will not revisit past cases that have been settled through the confidentiality agreement. Khosrowshahi, who introduced the mantra "we do the right thing, period" to his employees, has been leading the effort to change Uber's company culture after allegations of sexual harassment, discrimination and bullying.

Uber Technologies Inc on Tuesday became the second major company to scrap mandatory arbitration to settle sexual harassment or assault claims, giving victims several options to pursue their claims including public lawsuits.

Uber is due to respond in court by Wednesday about whether it will require the women in the proposed class action suit to carry out their assault claims in arbitration. To do so, it will develop a common taxonomy for how to classify sexual harassment and assault reports, which it plans to also make available to other companies.

However, in the end, Uber has decided it will go ahead and publish data. It isn't clear if the announcement and report are related. "We know that a project of this magnitude will take some time, but we pledge to keep you updated along the way".
