The California judge who sentenced Turner to six months in jail was recalled in June, making him the first California judge to be recalled in more than 85 years. That loophole is what inspired legislation reforming the rape statute in 2016 to include any type of non-consensual sexual assault.

A court ultimately convicted Turner of assault with intent to commit rape, sexual penetration of an intoxicated person with a foreign object and sexual penetration of an unconscious person with a foreign object. Turner never meant to rape an unconscious woman, he said.

Trial Judge Aaron Persky drew criticism when he sentenced Turner in June 2016 to six months in county jail, based on the recommendation of the probation department.

"I absolutely don't understand what you are talking about", Justice Franklin Elia told Multhaup, adding that the law "requires the jury verdict to be honored".

Assistant Attorney General Alisha Carlile argued that Multhaup had presented a "far-fetched version of events" that didn't support the facts of the case.

A lawyer for Brock Turner, the former Stanford student convicted of sexually assaulting an unconscious woman, argued in court during an appeal hearing that his client was seeking "outercourse" with his victim. Multhaup's strategy in pitching his "outercourse" theory was to argue that jurors in the Turner case made "unreasonable inferences" based on witness testimony and on medical examiners' determination that his victim was completely unconscious at the time of the assault.

Three California appellate justices have 90 days to discuss Multhaup's appeal argument as well as issue a ruling on the appeal.
