The order, which some regulatory experts said was unprecedented in recent memory, sets the stage for a legal battle between New York's top telecommunications regulator and the state's largest cable and internet service provider.

NY is accusing Charter of failing to meet its commitments have led to the move.

The commission's approval of the merger in January 2016 was contingent on Charter bringing broadband service to 36,250 new addresses per year for four years.

The order from the New York Public Service Commission accuses Charter of "persistent actions demonstrating bad faith", claiming that the company has repeatedly failed to live up to promises it made during the merger approval process to connect more New Yorkers to high-speed Internet.

NY state announced on Friday, July 27 that Charter Communications, Inc., also doing business as Spectrum, is no longer permitted to serve customers in the Empire State.

It's rare to see a state try to undo a merger this way and prohibit a company from operating (in its current form) in the state, but NY is clearly unhappy with Charter's actions in the wake of this merger, and displeased enough that they're moving beyond fines to merger revocation.

Charter provides digital cable television, broadband internet and phone service to more than 2 million people in New York, including New York City.

"We need to seek a different provider", Rhodes said before voting in favor of the measures. This means that the company can no longer operate in the state and in essence forfeits future revenue from roughly 2 million subscribers. NY will not tolerate Charter's gaslighting its own customers into believing it is meeting its promises.

"The Company has had multiple opportunities to correct these issues and either has not done so or has been openly brazen in its efforts to avoid them", the commission said.

A spokesperson released the following statement: "In the weeks leading up to an election, rhetoric often becomes politically charged".

In a statement, Charter spokesman Andrew Russell suggested the commission's actions were being politically motivated but did reveal what the company's next step would be.

"The fact is that Spectrum has extended the reach of our advanced broadband network to more than 86,000 NY homes and businesses since our merger agreement with the PSC", the email from Charter stated.
