Trump Plans to Legally Exterminate Transgender People, Define Gender by Genitalia at Birth: Memo

The Trump administration is reportedly working to dramatically roll-back protections for transgender students and narrow the definitions of sex and gender that courts have increasingly used to provide protections for LGBTQ people.

But officials at the department confirmed that their push to limit the definition of sex for the goal of federal civil rights laws resulted from their own reading of the laws and from a court decision. By defining sex so rigidly, it would essentially ignore intersex people as well as transgender people.

Maj. David Eastburn, a Pentagon spokesman, said the announcement of a new policy would have no immediate practical effect on the military because the Pentagon has been obliged to continue to recruit and retain transgender people in accordance with current law. Both regulations are expected to be released this northern autumn, and would then be open for public comment, typically for 60 days. That was one of the reasons for the move for a new, standard definition by HHS.

Civil rights groups have been meeting with federal officials in recent weeks to argue against the proposed definition, which has divided career and political appointees across the administration.
