Trump ex-campaign chair Manafort sues Mueller Rosenstein and Department of Justice

President Trump's former campaign chair doesn't have a case in his lawsuit against FBI Special Counsel Robert Mueller, according to one legal expert.

On Wednesday, Manafort filed a civil complaint against Mueller and Deputy Attorney General Rod Rosenstein, alleging the Russian Federation probe has gone beyond the scope of the special counsel regulations.

"The investigation has focused on Mr. Manafort's offshore business dealings that date back to as early as 2005 - about a decade before the Trump presidential campaign launched", the lawsuit said.

Manafort's civil lawsuit, filed in U.S. District Court for the District of Columbia, accuses Rosenstein of exceeding his legal authority to "grant Mr. Mueller carte blanche to investigate and pursue criminal charges in connection with anything he stumbles across". Even if the appointment order is lawful, Manafort's indictment ignored the jurisdictional boundaries, according to the suit.

"Those limitations prevent the special counsel from becoming an unaccountable roving commission, with virtually unlimited resources, that can delve into citizens' lives in search of criminality unrelated to the specific matters the special counsel was appointed to address", the lawsuit says.

But Turley said there is no doubt that the charges against Manafort are far removed from the original objective of Mueller's investigation, which was Russian interference in the 2016 election and alleged collusion by the Trump campaign.

Mueller's office declined to comment.

Trump, in social media postings after Christmas and New Year's Day, has attacked the special counsel investigation, Justice Department and the FBI, including the FBI's former director, James Comey; former General Counsel James Baker; and Deputy Director Andrew McCabe. It comes amid Republican allegations of partisan bias among members of Mueller's team, which for months has been investigating whether the Trump campaign coordinated with Russian Federation to influence the outcome of the US election.

A Justice Department spokesperson gave this statement to BuzzFeed and Politico: "The lawsuit is frivolous but the defendant is entitled to file whatever he wants".

Mr. Manafort is challenging Mr. Mueller at the same time that some Republicans are accusing the former Federal Bureau of Investigation director of putting together a biased prosecution team dotted with lawyers who contributed campaign money to Democrats, including Hillary Clinton. His lawyers argue that Mr. Mueller should be allowed to investigate only matters that directly arise from the Russian Federation investigation.

Rosenstein had been tasked with overseeing the probe after Attorney General Jeff Sessions recused himself from the investigation.

He said that during the 2014 interview, he discussed in detail his activities in Ukraine, his relationships with diplomats in Kyiv, and his offshore banking in Cyprus.

"Mr. Rosenstein has not responded; nor has anyone else from his office", the complaint said.

Manafort and his longtime associate Rick Gates were charged in late October with money laundering, failing to report overseas bank accounts, failing to register as lobbyists for foreign entities, and making false statements.

At issue is whether the scope of Rosenstein's order is too broad and runs afoul of the Justice Department's rules that establish procedures for hiring a special prosecutor.
