Pakistan has demanded that Col. Joseph Emanuel Hall’s diplomatic immunity be waived so that he can face a criminal trial over a fatal traffic accident but American officials have refused
The government reportedly took the decision after the U.S. government assured that Col Hall will be tried under USA laws, the sources added.
On April 7, Colonel Joseph jumped a red light and rammed into a motorcycle killing a Pakistani civilian.
The Federal Investigation Authority (FIA) had on Sunday barred United States defence attaché Col Joseph Emanuel Hall from leaving Pakistan, forcing an American military aircraft flown in for his departure to leave without him. The diplomat has since left for Afghanistan on a special flight.
He enjoyed immunity from any criminal, administrative or civil action, they said. The incident killed a youth, identified as 22-year-old Ateeq Baig, while the pillion rider received serious injuries. He was let go by police officials in Islamabad after the accident as the law - Vienna Convention on Diplomatic Relations, 1961 - provided the diplomat immunity from criminal prosecution.
