Lawyers For Pulse Nightclub Shooter's Widow Ask Judge To Toss The Case

Attorneys for Noor Salman are calling for a mistrial after they say new details from prosecutors reveal that Pulse gunman Omar Mateen's father was an FBI source and is now under a criminal investigation.

Salman's attorneys claim the late disclosure of the information prevented them from exploring whether or not Seddique Mateen knew of his son's plans to attack the nightclub on June 12, 2016.

Noor Salman moved to the San Francisco area after her husband, Omar Mateen, was killed in a shootout with SWAT team members during the June 12 massacre at the Pulse nightclub in Orlando.

Her lawyers' federal court motion filed Monday says U.S. Attorney Sara Sweeney sent them an email Saturday revealing some details of the FBI's involvement with and knowledge of Seddique Mateen's activities leading up to the Pulse attack.

Defense attorneys say the failure to share this information in advance of her trial violates Salman's Fifth Amendment right to due process and Sixth Amendment right to a fair trial, because her defense would have investigated "whether Mateen's father was involved in or had foreknowledge of the Pulse attack", they wrote.

Seddique Mateen was on the prosecution's witness list, but was not called to testify in the trial. The admonishment came after the testimony of an Federal Bureau of Investigation agent who said he knew "within days" of Mateen attacking Pulse that it was "highly unlikely" that Mateen or his wife Salman had driven to scout out the location in the days before the attack, which contradicts a confession Salman allegedly gave to Federal Bureau of Investigation agents.

"I'm as shocked as you are because I didn't notice, as I said always in the past two days, I didn't notice anything, irregular behavior on his part or emotional behavior on his part", Seddique Mateen said.

Martin said he considered trying to develop Mateen as an informant, like his father, after finding he didn't have ties to terrorism.

Investigators found receipts from money transfers to Turkey and Afghanistan from March to early June 2016, the filing indicates.

It further revealed, FBI, on November 1, 2012, through an anonymous tip learned that "Seddique Mateen was seeking to raise $50,000 - $100,000 via a donation drive t, contribute towards an attack against the government of Pakistan".

They said prosecutors also told them in an email Saturday that the government found evidence on the day of the attack that Omar Mateen's father, Seddique Mateen, had been sending money to Afghanistan and Turkey, possibly to fund violent insurrection against the government of Pakistan.

The father further said that he was saddened by his son's actions during the Muslim holy month of Ramazan.

Salman is on trial, charged with providing material support to a foreign terror organization, the Islamic State group, and with obstructing justice.

Her defense attorneys have said they plan to tell jurors that Salman was diagnosed with PTSD because of Mateen's domestic abuse. In her opening statements, defense attorney Linda Moreno said Salman is a "trusting, simple" person with a low IQ, who did not know she would be widowed because her husband became "a martyr for a cause that she didn't support".

Somewhat ironically, in addition to his connection to the FBI, Seddique Mateen was a staunch supporter of 2016 Democratic presidential nominee Hillary Clinton.

As part of their case against Salman, prosecutors allege that she texted her husband a "cover story" to tell his parents that night to hide his plans.

Byron told jurors last week they could expect closing arguments on Wednesday, which means a verdict could come by the end of the week.
